Public Hearing May 10, 2007: Proposed Ordinance 11-3-3(c)

A public hearing will be held at City Hall before the Grangeville Planning and Zoning Commission on the 10th day of May, 2007, at 7:00 P.M. on the following ordinance.

GRANGEVILLE CITY ORDINANCE NO. ______

AN ORDINANCE OF THE CITY OF GRANGEVILLE PROVIDING FOR THE AMENDMENT OF PORTIONS OF SECTION 11-3-3(C) OF THE MUNICIPAL CODE OF THE CITY OF GRANGEVILLE TO REQUIRE TEN (10) COPIES OF PRELIMINARY PLATS AND TEN (10) COPIES OF PRELIMINARY ENGINEERING PLANS UPON PLAT SUBMISSION AND MODIFYING SECTION 11-3-3(D)(14) TO EXPLAIN THE CITY’S NON-ENFORCEMENT OF RESTRICTIVE COVENANTS OR DEED RESTRICTIONS; PROVIDING FOR THE RETENTION OF THE BALANCE OF SECTION 11-3-3; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR THE ORDINANCE BECOMING EFFECTIVE UPON ITS PASSAGE, APPROVAL, AND PUBLICATION.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF GRANGEVILLE, IDAHO COUNTY, IDAHO, AS FOLLOWS:

Section 1: Section 11-3-3(C) of the Grangeville Municipal Code shall be amended to read as follows:

C. Contents Of Preliminary Plat: The contents of the preliminary plat and related information shall be in such form as stipulated by the Commission; however, any additional maps or data deemed necessary by the Administrator may also be required.

The subdivider shall submit to the administrator at least the following:
1) Six (6) Ten (10) copies of the preliminary plat of the proposed subdivision, drawn in accordance with the requirements hereafter stated; each copy of the preliminary plat shall be on good quality paper, shall have dimensions of not less than one inch (1”) to one hundred feet (100’), shall show the drafting date, and shall indicate thereon, by arrow, the generally Northerly direction.
2) Six (6) Ten (10) sets of preliminary engineering plans (not to meant to be cross sections or detailed designs) for streets, water, sewers, sidewalks, surface, and subsurface drainage and other required public improvements; however, such engineering plans shall contain sufficient information and detail to enable proposed improvements to applicable regulations, ordinances, and standards.

Section 2: Section 11-3-3(D)(14) of the Grangeville Municipal Code shall be amended to read as follows:

D(14)
a) A copy of any proposed restrictive covenants and/or deed restrictions.
b) Any covenants and/or deed restrictions are a private contract between the developer and the property owners and as such will not be enforced by the City.

Section 3: All ordinances or parts of ordinances in conflict herewith shall be repealed.

Section 4: This ordinance shall be effective upon its passage, approval, and publication in the Idaho County Free Press after notice and hearings having been properly held pursuant to the Local Planning Act notice provisions set forth in Idaho Code §67-6509, as amended.
