Public Hearing May 10, 2007: Proposed Ordinance 11-5-3
A public hearing will be held at City Hall before the Grangeville Planning and Zoning Commission on the 10th day of May, 2007, at 7:00 P.M. on the following ordinance.

GRANGEVILLE CITY ORDINANCE NO. ______
AN ORDINANCE OF THE CITY OF GRANGEVILLE PROVIDING FOR THE AMENDMENT OF SECTION 11-5-3 OF THE MUNICIPAL CODE OF THE CITY OF GRANGEVILLE AND REMOVING FROM SAID SECTION PARAGRAPH E, RELATING TO INSPECTION OF IMPROVEMENTS AND CONSTRUCTION, AND MOVING SAID SECTION, WHICH IS 11-5-3(E), TO BE INCLUDED WITHIN SECTION 11-3-4(C) OF THE MUNICIPAL CODE RELATING TO SUBDIVISION DEVELOPMENT FEES AND INSPECTION; MODIFYING THE SUBDIVISION DEVELOPMENT FEE COSTS TO INCLUDE ALL INCURRED COSTS OF INSPECTION AND INCURRED TESTING COSTS DURING SUBDIVISION INSPECTIONS; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR THE ORDINANCE BECOMING EFFECTIVE UPON ITS PASSAGE, APPROVAL, AND PUBLICATION.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF GRANGEVILLE, IDAHO COUNTY, IDAHO, AS FOLLOWS:
Section 1: Section 11-5-3(E) of the Grangeville Municipal Code as it now exists, which reads as follows:
E. Inspection of Public Improvements Under Construction: Before approving a final plat and construction plans and specifications for public improvements, an agreement between the subdivider and the City Council shall be made to provide for checking or inspecting the construction and its conformity to the submitted plans.
Said section shall be moved and become part of section 11-3-4(C), which section shall now read as follows:
Inspection of Public Improvements Under Construction and Fees for the Same:
1) A fee of $240.00, plus $5.00 per lot, for a final plat review plus the actual cost of all necessary traffic control, pedestrian, and street identification signs to be placed in the subdivision. The City shall locate and install all signs at cost to the developer.
2) A fee of the greater of 1% or the actual construction cost and inspection fees incurred by the City shall be charged for engineering inspection. Additionally, any and all special testing expenses incurred by the City for testing during the construction period and at the end thereof shall likewise be paid by the developer.
3) a. Inspection of Public Improvements Under Construction: Before approving a final plat and construction plans and specifications for public improvements, an agreement between the subdivider and the City Council shall be made to provide for checking or inspecting the construction and its conformity to the submitted plans.
b. Any inspector hired by the City and paid in accordance with this section shall be a City employee or independent contractor engaged by the City and the frequency of inspections, required testing, and fee reimbursement required pursuant to this section shall be adjusted in the discretion of the City depending on project size and complexity.
Section 2: The balance of section 11-3-4, existing at this time, of the Grangeville City Code shall remain unamended and be maintained in full force and effect.
Section 3: All ordinances or parts of ordinances in conflict herewith shall be repealed.
Section 4: This ordinance shall be effective upon its passage, approval, and publication in the Idaho County Free Press after notice and hearings having been properly held pursuant to the Local Planning Act notice provisions set forth in Idaho Code ยง67-6509, as amended.
