Public Hearing May 10, 2007: Proposed Ordinance 8-6-3
A public hearing will be held at City Hall before the Grangeville Planning and Zoning Commission on the 10th day of May, 2007, at 7:00 P.M. on the following ordinance.

GRANGEVILLE CITY ORDINANCE NO. ______
AN ORDINANCE OF THE CITY OF GRANGEVILLE RELATING TO THE DRILLING OF DEEP WATER WELLS WITHIN THE CITY OF GRANGEVILLE AND WITHIN THE GRANGEVILLE AREA OF CITY IMPACT; PROVIDING AN AMENDMENT OF SECTION 8-6-3 OF THE MUNICIPAL CODE OF THE CITY OF GRANGEVILLE INTER-RELATING THE PROVISIONS OF SECTION 8-6-4, WHICH ADDRESSES WELLS IN THE AREA OF CITY IMPACT TO THE PROHIBITION OF DRILLING SUCH WELLS; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR THE ORDINANCE BECOMING EFFECTIVE UPON ITS PASSAGE, APPROVAL, AND PUBLICATION.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF GRANGEVILLE, IDAHO COUNTY, IDAHO, AS FOLLOWS:
Section 1: Section 8-6-3 of the Grangeville Municipal Code shall be amended to read as set forth below:
8-6-3 Drilling Domestic Wells Prohibited:
A. Prohibited: It shall be unlawful for any person to dig, drill, or to have dug or drilled a well or otherwise to procure domestic waters for consumption of themselves or others or irrigation, within the City or the Area of City Impact after the effective date of this section.
The provisions for hardship described in the existing section 8-6-4 shall continue to apply in both the City and the County hereafter.
B. Existing Wells: Any person owning property upon which there exists an already existing domestic water well will, at no time, connect any piping from the well to piping which is connected to the City’s municipal water system.
Section 2: All ordinances or parts of ordinances in conflict herewith shall be repealed.
Section 3: This ordinance shall be effective upon its passage, approval, and publication after hearings having been properly held pursuant to the Local Planning Act notice provisions set forth in Idaho Code §67-6509, as amended.
